The Guidelines and Association Rules provide an overall framework and a comprehensive set of guidelines by establishing criteria for the design, size, location, style, structure, materials and color of architecture and landscaping, as well as relevant
criteria for the construction or modification of all improvements made by any party other than the “Declarant”.
No structure whatsoever, other than one private, Single Family residence, together with a private garage for not more than four cars, one gazebo, one tennis court and one storage Facility (all of which must be approved in advance by the Architectural Committee in accordance with this Declaration), as well as a swimming pool (which shall not be subject to Architectural Committee approval except as to any above ground structures appurtenant thereto), shall be erected, placed or permitted on any Lot.
No gainful occupation, profession, trade or other non-residential use shall be conducted on or in any Lot. The entire (but not less than all of a Dwelling Unit on a Lot may be leased to a Single Family tenant from time to time by the Owner thereof, subject to the provisions of this Declaration, any applicable Subsidiary Declaration and the Association Rules.
Section 10.1 shall not be deemed to prevent an Owner or Occupant from conducting his or her personal and non-business affairs on his or her Lot.
Section 10.1 also shall not be deemed to prevent an Owner or Occupant from using the Dwelling Unit on his or her Lot for business purposes which: (a) utilize, on an exclusive or non-exclusive basis, a minimal portion of such Dwelling Unit; (b) do not result in the use of the Dwelling Unit for business meetings or appointments; (c) do not result in shipping from the Lot: (d) do not result in large or excessive amounts of deliveries to the Lot; and (e) do not otherwise violate local zoning and use laws.

If you wish to rent your home in Scottsdale Mountain, you need to be in compliance with the leasing policy.
No Owner may lease less than his entire Lot and the Residence situated thereon. All leases must be in writing and must provide that the terms of the lease are subject in all respect to the provisions of the Community Documents and that any violation of this Declaration or the Association Rules by the lessee or the other occupants shall be a default under the lease.
No Lot shall be leased for a period of less than thirty (30) days. There shall be no subleasing of Residences or assignments of leases.
At least ten (10) days before commencement of the lease term, the Owner shall provide the Association with the following information: (a) the commencement date and expiration date of the lease term; (b) the names of each of the Lessees and each other person who will reside in the Residence during the lease term; (c) the address and telephone number at which the Owner can be contacted by the Association during the lease term; and (d) the name, address and telephone number of a person other than the Owner whom the Association can contact in the event of an emergency involving the Lot.
Any Owner who leases his Lot and the Residence situated thereon must provide the Lessee with copies of this Declaration, the Design Guidelines and the Association Rules.
Any lease of a Lot or Residence situated thereon must be for an initial term of at least one (1) month.
The Owner shall be liable for any violation of this Declaration, the Design Guidelines or the Association Rules by the Lessees or other persons residing in the Residence and their guests or invitees and, in the event of any such violation, the Owner, upon demand of the Association, shall immediately take all necessary actions to correct any such violations.

Scottsdale Mountain Community Association is a community designed to respect the climate and regional character of its location, minimize environmental impact and maximize water and energy conservation principles. In order to implement and preserve these principles, these Guidelines and Association Rules have been established to maintain certain standards by
which the community may grow and develop.

Except as expressly provided herein or as expressly approved by the Architectural Committee, landscaping on the Property shall be consistent with the character of the natural environment surrounding the Property, shall comply with any and all provisions of the Guidelines relating to permitted or prohibited plants, and shall comply with all applicable governmental requirements, including but not limited to all natural area open space ordinances, regulations and requirements of the City.
Subject to the foregoing, all Lots and Parcels (other than Condominium Units), excluding driveways and parking areas, and excluding that portion of the Lot or Parcel, if any, which is enclosed by a perimeter wall around the rear yard, shall be landscaped in a manner and using plants and soil approved in advance by the Committee.
No exterior trees, bushes, shrubs, plants or other landscaping shall be planted or placed upon any Lot or Parcel except in compliance with plans and specifications therefor which have been submitted to and approved by the Architectural Committee in accordance with this Article 9 and the Guidelines.
No material changes or deviations in or from the plans and specifications for any work to be done on any Lot or Parcel once approved by the Architectural Committee, shall be permitted without approval of the change or deviation by the architectural Committee.
Neither this Section 9.12 nor Sections 9.3 or 9.4 above shall be construed to prevent normal landscape maintenance or the replacement of dead or diseased plants with other similar plants and by applicable governmental requirements, including, but not limited to, all natural area open space ordinances, regulations and requirements of the City.
Within one hundred twenty (120) days after the date on which a Lot is first conveyed to a Purchaser, landscaping (and an irrigation system sufficient to adequately water such landscaping) must be installed in the front yard and rear yard of any Lot with view fencing.
All landscaping in the front yard and rear yard of any Lot with view fencing must comply with the Design Guidelines.
